This binding legal agreement establishes your rights, responsibilities, and obligations when participating in CyberGuard Academy's cybersecurity training programs.
Legal Agreement & Binding Nature
These Terms and Conditions constitute a legally binding agreement between you ("Student," "User," or "You") and CyberGuard Academy ("Company," "We," "Us," or "Our") regarding your participation in cybersecurity training programs, access to educational resources, and use of our training platforms and services.
By enrolling in any cybersecurity training program, creating an account, accessing virtual laboratories, or using any CyberGuard Academy services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions, our Privacy Policy, and all applicable laws and regulations.
Legal Enforceability
This agreement is governed by the laws of Sri Lanka. Your continued use of our cybersecurity training services after any modifications to these terms constitutes acceptance of the revised agreement. If you disagree with any provision, you must immediately discontinue use of all CyberGuard Academy services.

User Conduct Requirements
Professional Standards
- • Maintain the highest standards of professional and ethical conduct throughout all cybersecurity training activities
- • Respect fellow students, instructors, and staff in all interactions and communications
- • Uphold the principles of responsible disclosure and ethical hacking in all practical exercises
- • Contribute positively to the learning environment and cybersecurity community
Compliance Obligations
- • Comply with all applicable local, national, and international laws regarding cybersecurity practices
- • Adhere to industry standards and professional codes of conduct for cybersecurity professionals
- • Follow all platform rules, safety guidelines, and laboratory protocols
- • Report any suspected violations or security incidents immediately to academy staff
Prohibited Activities & Behaviors
Strictly Prohibited Actions
- • Unauthorized access attempts to systems outside designated training environments
- • Development, distribution, or deployment of malicious software or exploits for harmful purposes
- • Harassment, discrimination, or intimidation of other students, instructors, or staff members
- • Violation of intellectual property rights through unauthorized copying or distribution of materials
Academic Misconduct
- • Cheating on assessments, examinations, or certification tests
- • Plagiarism of coursework, projects, or research submissions
- • Unauthorized collaboration on individual assignments or assessments
- • Falsification of credentials, experience, or academic records
Content Guidelines & Restrictions
- • Appropriate Content: All user-generated content must be relevant to cybersecurity education and maintain professional standards
- • Prohibited Material: No posting of offensive, discriminatory, illegal, or inappropriate content in forums or communications
- • Confidentiality: Respect confidentiality of other students' work, personal information, and proprietary training materials
- • Platform Integrity: Do not attempt to circumvent security measures, exploit vulnerabilities, or disrupt platform operations
Age Restrictions & Requirements
- • Minimum Age: Participants must be at least 18 years old for advanced cybersecurity training programs
- • Parental Consent: Students aged 16-17 may participate with written parental consent and supervision
- • Legal Capacity: All students must have legal capacity to enter into binding agreements
- • Identity Verification: Valid government-issued identification required for certification programs
2Liability Limitations & Warranty Disclaimers
Disclaimer of Warranties
CyberGuard Academy provides cybersecurity training services on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:
- • Merchantability and fitness for a particular purpose
- • Non-infringement of third-party rights
- • Uninterrupted or error-free service operation
- • Complete accuracy of training materials or assessments
- • Guaranteed employment or career outcomes
- • Certification pass rates or examination success
- • Compatibility with all devices or systems
- • Security or privacy of third-party integrations
Limitation of Liability
In no event shall CyberGuard Academy, its directors, employees, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- • Loss of profits, revenue, or business opportunities
- • Damage to professional reputation or career prospects
- • Cost of substitute training or educational services
- • Loss of data, files, or coursework
- • Personal injury or emotional distress
- • Third-party claims or legal proceedings
- • System downtime or technical difficulties
- • Failure to achieve certification or employment
Maximum Liability Cap: Our total liability shall not exceed the amount paid by you for the specific cybersecurity training program in the preceding 12 months.
Consequential Damages Exclusion
You acknowledge and agree that CyberGuard Academy shall not be responsible for any consequential damages arising from:
- • Actions taken based on knowledge gained through cybersecurity training programs
- • Use of techniques, tools, or methodologies learned in educational contexts
- • Employment decisions, hiring processes, or career advancement opportunities
- • Third-party certification examination results or professional recognition
- • Technical issues with student-owned devices or personal network configurations
Force Majeure Provisions
CyberGuard Academy shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:
- • Natural disasters, pandemics, or public health emergencies
- • Government actions, regulations, or travel restrictions
- • Internet service provider outages or infrastructure failures
- • Cyber attacks, data breaches, or security incidents
- • Labor disputes, strikes, or personnel shortages
- • Equipment failures or third-party service disruptions
- • Changes in educational licensing or certification requirements
- • Economic sanctions or international trade restrictions
3Legal Framework & Dispute Resolution
Governing Law & Jurisdiction
- • Applicable Law: These Terms and Conditions are governed by the laws of Sri Lanka
- • Jurisdiction: Courts of Colombo, Sri Lanka have exclusive jurisdiction over disputes
- • Legal Venue: All legal proceedings must be conducted in English language
- • International Students: Sri Lankan law applies regardless of student's country of residence
Dispute Resolution Procedures
- • Initial Contact: All disputes must first be addressed through our student support system
- • Mediation: Good faith mediation required before formal legal proceedings
- • Arbitration: Binding arbitration may be required for certain commercial disputes
- • Time Limits: Legal claims must be filed within 12 months of the incident
Severability Clause
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. The remainder of these terms shall remain in full force and effect.
Preservation of Agreement

- • Misuse of cybersecurity knowledge, tools, or techniques learned in training programs
- • Unauthorized access to computer systems or networks using academy-taught methods
- • Infringement of intellectual property rights or confidentiality agreements
- • Harmful or illegal activities conducted using CyberGuard Academy credentials or reputation
4Additional Legal Provisions
Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any program-specific agreements, constitute the entire agreement between you and CyberGuard Academy.
- • Supersedes all prior negotiations and agreements
- • No oral modifications or additions
- • Written amendments require authorized signatures
Assignment & Transfer
You may not assign or transfer your rights or obligations under these terms without our written consent.

Survival of Terms
The following provisions shall survive termination of your enrollment or these Terms and Conditions:
